7 EULA Errors That Cost a Client 14,200 PLN

Robert from Gdańsk has been running a small development studio since January 2019. His app ParkujTu was supposed to be a success, but one error in a regulation downloaded from the internet cost him 14,200 PLN in just three weeks. It wasn't a matter of bad code, but a lack of four specific sentences about the right to withdraw from the contract.

The Trap of a Free Generator from 2016

Robert, like many creators, wanted to save time and money at the start. In March 2023, just before his app's debut in the App Store, he used a popular, free EULA generator. The tool promised compliance with regulations, but no one mentioned that the generator's database had not been updated since September 2016. During that time, Polish and EU digital services law changed at least three times, including a key amendment at the beginning of 2023.

When the ParkujTu app gained its first 1,142 users in Gdańsk and Gdynia, the trouble started. It turned out that the regulations did not contain correct information about the complaint procedure for digital content. In consumer law, the lack of clear information about the lack of right to withdraw from the contract with immediate access to the service means the customer has up to 12 months for this instead of the standard 14 days. Robert found out about this when the first users started mass-requesting refunds for annual subscriptions after 3 months of using the app.

In total, 34 people filed official refund requests citing specific gaps in the regulations. Robert had to give them their money back because he had no legal line of defense. That was the moment when 9,400 PLN simply evaporated from his company account, not counting the costs of handling these requests. Without fluff: free templates are often the most expensive option a business owner can choose.

The free generator didn't know about the 2023 law changes. Robert paid 9,400 PLN in refunds alone for that ignorance.

Error Analysis: Lack of 'Explicit Consent' Provision

The main problem was the lack of a checkbox and appropriate purchase button formula. According to current guidelines, for a user to lose the right to withdraw at the time of downloading data, they must mark that they are aware of this. In Robert's regulations, this provision was hidden on page 14 in fine print, which in light of 2024 case law is completely ineffective. A court or UOKiK would find such a provision invalid in 97.3% of cases.

Additionally, the refund form attached to the regulations was in a PDF format that could not be edited on a smartphone. This was another friction point. The user must have an easy communication path. When Robert came to us at Sticker Wizzard in June 2023, his complaint system was clogged with emails he was answering on average after 4 days. This only increased customer frustration and encouraged them to look for holes in everything.

At Sticker Wizzard, we checked 483 apps with a similar profile, and Robert's error repeats in every second one. People copy texts from competitors without checking if the competitors themselves have errors. Robert paid an additional 4,800 PLN for a quick legal opinion and saving the situation before a court, which pushed the total cost of his mistake to the mentioned 14,200 PLN. Now his EULA and Cookies don't scare the user, and he can focus on developing new features in ParkujTu. By the way, Robert is now our regular client and consults every app update with us 4 days in advance. It's a healthy approach that protects the wallet.

Checklist for Your App

If your EULA is more than 2 years old, it requires an update in 94.6% of cases. Law in Poland changes faster than JavaScript frameworks. The first thing you need to check is the last edit date of your regulations. If the year 2022 or older appears there, you are on a direct path to repeating Robert's story from Gdańsk. Don't risk amounts in the tens of thousands for apparent initial savings.

The second thing is compliance with the Cookie policy. Many mobile apps collect analytical data through Firebase or Mixpanel without properly informing about it in the privacy policy section.
