EULA Audit Saved Startup from 32,000 PLN Fine
During mockup verification, we detected an error in the subscription process. We corrected the entries before the App Store debut, which blocked claims after a server crash.
GameForge from Wrocław was preparing for the premiere of a new mobile game with a subscription model. They had a ready product, but their regulations were a collage of random texts from the web. We checked their documentation 12 days before App Store submission and found errors that could have closed their business in the first month.
The challenge
The main problem was the mechanism for renewing subscriptions for 48.90 PLN per month. The app did not clearly inform about the moment funds were taken, violating EU consumer regulations. In case of a UOKiK audit, the company faced at least 32,487 PLN in administrative fines. Additionally, the lack of appropriate provisions about technical breaks exposed them to claims from 1,458 users who installed the game on the first day.
Our approach
We analyzed 14 different screens inside the game where the user encountered payments. Our team, including a process analyst, walked through the purchasing path on three different operating systems. We focused on ensuring the regulations (EULA) were integrated with the interface, not just a link hidden in the footer. We used our experience from 483 checked apps to eliminate legal jargon.
The solution
We prepared new EULA content that fit on 4 phone screens instead of the standard 18 pages. We implemented readable checkboxes during account activation that are legally binding but don't spoil the fun of the game. We also added specific clauses regarding so-called 'force majeure' for Cloud servers, protecting the developer against the effects of external infrastructure failure.
Results
Thanks to quick intervention, GameForge avoided fines and a wave of refund requests after a server crash occurred 4 days after the premiere. The app passed App Store verification the first time.
